LOUISIANA FEDERAL COURT FINDS HHA VIOLATED STARK LAWIn an interesting case handed down on February 16, 2007, the US District Court for the Western District of Louisiana in United States ex rel Roberts v. Aging Care Home Health, Inc. held that a home health agency that was found to have violated the Stark Law with respect to certain physician arrangements is liable to the Medicare program for over $400,000 based on theories of mistake and unjust enrichment.
